Terms of Service
These terms apply to your use of digitall.media and to services you book with Real Estate Photography ("we", "us"). By using the site or booking a shoot you agree to them.
Prices and bookings
- Prices on the pricing page are our current flat rates. The price for your order is confirmed when you book. We may change published prices at any time; changes do not affect orders already confirmed.
- You are responsible for having the property ready and accessible at the booked time, and for having the owner's permission for us to enter and photograph it.
- If you need to reschedule, let us know as early as possible.
Drone and weather
Aerial photography and video are flown by an FAA Part 107 certified pilot and depend on weather, airspace rules and any required authorizations. If conditions make a flight unsafe or not permitted, we will reschedule the aerial part of the shoot.
Delivery
Delivery times shown on the site are our usual turnaround, not a guarantee. We will tell you if an order will take longer.
Image ownership and license
- We keep the copyright in all photographs, video, tours and floor plans we create.
- When your order is paid, you receive a license to use the delivered media to market the property it shows: MLS, listing portals, your website, social media, print and email.
- The license does not allow selling the media, or passing it to other agents, builders, publications or third parties for their own use, without our written permission.
- We may show the media in our portfolio and marketing. If you need a shoot kept private, tell us when you book.
Virtual staging and decluttering
Virtually staged or decluttered images show what a space could look like. You are responsible for labeling them as virtually altered wherever your MLS or local rules require it.
Payment
Payment is due as agreed at booking. Media may be held until the order is paid.
Website content
The text, photos, video and design of this website belong to us. Please do not copy or reuse them without permission. Blog articles are general information; see our Disclaimer.
Limitation of liability
The site and its content are provided "as is". To the extent the law allows, our total liability for any claim related to a service is limited to the amount you paid for that service, and we are not liable for indirect or consequential losses such as lost commissions or delayed sales.
Governing law
These terms are governed by the laws of the State of Florida. Any dispute will be handled in the courts of Miami-Dade County, Florida.
Changes
We may update these terms. The version on this page on the date of your booking applies to that booking.
